1. Definitions

In these Terms and Conditions:

“you” or “your” means the person named in the booking confirmation;

“Glanusk Park Site Policy” means the relevant policy and rules in force at the Site (as updated from time to time);

“Site” means Glanusk Estate, Glanusk Park, Penmyarth Park and Glanusk’s Caravan Park at Glanusk Park, Glanusk Estate, Crickhowell, Powys, NP8 1LP; and

“we”, “us” or “our” means Glanusk Events LLP of The Old Library Chambers, 21 Chipper Lane, Salisbury, Wiltshire, SP1 1BG

2. Making a booking

By making a booking you are confirming that you are authorised to do so on behalf of all persons named in the booking, that all members of your party agree to be bound by these Terms and Conditions and that you will procure that all members of your party will comply with these Terms and Conditions.

We reserve the right to accept or decline bookings entirely at our discretion. You cannot make a booking if you are under 18 years old and any such bookings will be declined.

A booking is confirmed once we have received payment from you. If you wish to cancel your booking it will be subject to our cancellation terms set out at paragraph 3 below.

When your booking has been made a confirmation will be sent to you by email using the email address that you have supplied. You should retain a copy of this confirmation for your reference. If you do not provide us with an email address, we will not be able to confirm your booking or provide you with details about your booking via email. You can also book via the telephone on 01873 810414 if you are unable to book online. Booking confirmations are subject to the availability of accommodation at the Site.

You should carefully check the details of your booking confirmation as soon as you receive it.

You must contact us immediately if you believe any of the details in your booking confirmation are incorrect or incomplete. We will, where reasonably possible, rectify any inaccuracies or accommodate any alterations you wish to make to your booking at the Site. If you notice a mistake or inaccuracy in your booking confirmation, you must notify us as soon as possible and we will, where reasonably possible, amend your booking for you. If you fail to notify us of any inaccuracies or mistakes before the date of your stay at the Site, we may not be able to amend your booking.

If you have booked online or by telephone and provided an email address you should notify us immediately if that email address changes. We can only discuss your bookings (including any changes) with you, we cannot discuss the booking with another member of your party unless you give express consent for us to do so.

3. Payment Terms and Cancellation Policy

We periodically review and amend the prices we charge for your use of the property/site. We will confirm the cost of your booking at the time you make your booking and in your confirmation invoice.

For all bookings, full payment is required. All bookings made via our website are taken via a secure gateway. All bookings must be paid for in £GBP and include tax (VAT) at the current rate (20%). If the VAT rates change, we reserve the right to change our prices accordingly.

Your booking is a contract for the provision of leisure services on a specific date or dates and this means that you do not have a statutory right to change your mind and cancel the contract other than in accordance with our cancellation policy. For those cancellations made more than 4 weeks before arrival, you will be entitled to a refund of 50% of the booking cost. For cancellations made within 4 weeks of arrival, you will not be entitled to any refund of the booking cost. Cancellations must be notified in writing to us immediately by contacting us at [email protected].

4. Changing a Booking

If you want to change any detail of your confirmed booking you must let us know by contacting us on 01873 810414 or emailing us at [email protected] as soon as possible. Whilst we will do our best to accommodate you, we cannot guarantee that we will be able to meet any request for changes.

If we do change your booking, you will be charged an administration fee of £5 to cover the costs we incur in making the change to your booking in addition to any loss of income deemed to be as a direct result of the requested change.

Whilst we do not expect that we will have to make changes to your booking, we reserve the right to change or cancel your booking if it is necessary to perform or complete essential remedial or refurbishment works of the Site or for other reasons unforeseen at the time you made your booking with us which are beyond our reasonable control. Where such an event occurs, we will do our best to offer you a suitable alternative booking. If we are not able to offer you a suitable alternative, or if you do not accept the alternative we offer, the booking will be deemed cancelled and we will refund you the total amount you have paid us for the booking.

5. Cancellation by Us

We reserve the right, in our sole discretion, to refuse any booking and to cancel any bookings already made if the Site is unavailable for any reason whatsoever. If such an event occurs, you will entitled to a full refund of all monies paid to us by you. You agree that this will be your sole remedy and that we will not be responsible for any other losses you may incur arising from our cancellation of your booking. If only part of the Site is unavailable, we will to the extent it is reasonably possible try and find you alternative accommodation on the Site.

We reserve the right to terminate our contract with you immediately and remove you and your party from the Site if, in our sole discretion, we determine that you or any person in your party acts in an unreasonable, anti-social, distasteful, dangerous, threatening, reckless, offensive, derogatory, prejudicial, aggressive or violent manner or is likely to or has caused any damage or nuisance to any property or third parties on or nearby to the Site, or who is acting illegally in any way. You agree that where such an event occurs that neither you nor any member of your party will be entitled to a refund of any monies paid to us and or any other form of compensation.

We reserve the right to cancel our contract with you and ask you to leave our Site immediately (without any refund or compensation being payable) to you if we consider that you or your party have committed a material breach of these Terms and Conditions.

6. Insurance

It is a condition of your booking that you obtain appropriate insurance for you and all members of your party. This should ideally cover illness, cancellation, damage or loss to property and injuries during your stay.

7. Occupancy period

You and your party shall only occupy the Site as holiday accommodation and you agree that the Site shall not be shall not be occupied by you or a member of your party’s sole or main place of residence. You also agree that neither you nor your party shall occupy the Site for 28 days or more in any calendar year. We reserve the right to evict any persons who have occupied the Site for longer than 28 days in any calendar year, or who are using the Site as their main or sole residence. In accordance with our Privacy Policy (which can be found on our website, an up to date register will be kept of names of all occupiers of the Site, their main or sole residence, their date of arrival and departure from the site.

8. Liability

Nothing in these Terms and Conditions is intended to limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any other liability that cannot be excluded by law.

Subject to the above paragraph, if we are held liable to you for any loss or damage arising in connection with this these Terms and Conditions and/or the Site, our aggregate liability to you (whether arising from negligence, breach of contract or otherwise) shall be limited to the amount of monies that has been paid by you to us.

We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach of these Terms and Conditions or if it was contemplated by you and us at the time we entered into this contract.

Save for where your loss has been directly caused by our recklessness, negligence or breach of these Terms and Conditions, we do not accept any liability to you for any loss, theft or damage to you or your party’s property (including, without limitation, your vehicles, contents and accessories).

We are not liable for any business losses. If you use the Site for any commercial or business purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

ALL OF YOUR BELONGINGS AND YOUR PARTY’S BELONGINGS ARE LEFT ENTIRELY AT YOUR OWN RISK.

YOU SHALL, AND SHALL PROCURE THAT YOUR PARTY SHALL, TAKE GOOD CARE OF AND DO NOT CAUSE ANY LOSS OR DAMAGE TO BE DONE TO THE PROPERTY/SITE, OR TO ANY FITTINGS, EQUIPMENT OR OTHER PROPERTY (INCLUDING THIRD PARTY PROPERTY) CONNECTED TO THE PROPERTY/SITE AND YOU SHALL MAKE GOOD AND PAY IN FULL FOR ANY SUCH LOSS OR DAMAGE CAUSED TO THE PROPERTY/SITE OR ANY PROPERTY CONNECTED TO THE PROPERTY/SITE WHICH IS CAUSED BY YOUR NEGLIGENCE OR RECKLESSNESS.

9. Force Majeure

We will not be responsible for any failure to perform our obligations under these Terms and Conditions that is caused by an event outside our control.

An event outside our control means any act or event that is beyond our reasonable control, including without limitation severe weather event, drought, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, strikes or industrial action by third parties, terrorist attack or threat of terrorist attack, war or threat of war, civil commotion, riot, invasion, or failure of public or private telecommunications networks.

10. Data Protection

We care about your privacy and will only process your personal data in accordance with data protection law. All the information taken at the time of your booking is used in accordance with our Privacy Policy. You acknowledge receipt of our Privacy Policy which can be found on our website.

11. Site Rules

You shall, and shall procure that your party shall, comply with the Glanusk Park Site Policy at all times which can be found on our website. You and your party shall comply with all health and safety laws including, without limitation, our health and safety policies as notified to you (and as updated from time to time). You should read and sign to confirm that you understand all fire safety instructions and precautions.

12. General

A person who is not a party to these Terms and Conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

These Terms and Conditions, the Glanusk Park Site Policy and our Privacy Policy constitute the entire agreement between you and us and supersede and extinguish all previous promises, representations and undertakings.

If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these Terms and Conditions.

These terms and conditions are governed by English law. You and we both agree to submit to the exclusive jurisdiction of the English courts.

If booking over the phone you will need to sign a copy of these terms and conditions and the associated policies to confirm you have read the information above, and accept the terms and conditions, and return a signed copy to the Estate Office by post or email to [email protected]

If you are booking through our website you are agreeing to the terms and conditions and the associated policies by ticking the box on booking.

GLANUSK CARAVAN PARK SITE POLICY

1. Seasons of occupancy

No Caravan, Campervan, Motorhome or tent shall remain on site between 1st November in any year and 27th February in the succeeding year.

2. Arrival and departure times

Caravans or Motorhomes shall not be permitted to enter and leave the site outside the hours of 8am and 7pm daily. This is to safeguard the amenities of the locality and is a condition imposed by the National Parks Authority.

3. Access and exit to and from the site

Access to the site is via the B4558 only.

Please contact Reception on arrival to be admitted to the site. You will see a key pad at the gateway which has an intercom button for the Estate Office, use this one and you will talk to one of our team and allowed access by opening the automated gates. When leaving the Park, on approaching the double gated access, the gates will open towards you. Please don’t ever force the gates open as this will damage them. When re-entering you will use the same access gates through which you arrived and use the same entry method.

When leaving the Park to explore the area on foot or bike, there are maps and information available at Reception.

When leaving the Park in a car to explore the local area you can access and exit via the double gated access as above.

4. Problems

If there are any problems with your access, pitch or utility of the site, please contact Reception.

5. Group Bookings

For group bookings, please notify us by contacting us at 01873 810414 or [email protected] so that we are able to make all possible efforts to locate you at pitches nearby each other.

6. Check in and Check Out

Guests departing and checking out of the site must do so before 12noon on the day of their departure. Please notify Reception before leaving.

Guests arriving to check in may do so after 1pm on the day of their arrival.

7. Pets

Guests are welcome to bring up to 2 well behaved dogs. Glanusk is a busy working estate and sheep are often in the fields surrounding Glanusk Caravan Park Site. Dogs must be kept on a lead at all times to avoid worrying livestock and for the safety of your dogs. Please also note that a permissive path runs through the estate and walkers are often accompanied by their dogs. Poop bags and a special bin are provided – please clean up after your dog. There is a wood adjacent to the Park and a dedicated dog walking field which are lovely areas for you to walk your dog(s).

8. No Smoking

Smoking is not permitted in the Amenity building or within 4 metres of any of the structures, temporary or otherwise offered by Glanusk Events LLP. Smoking is permitted outside and we would request that that all butts are collected and disposed of in the ash bins provided.

9. Conduct of Guests

Whomever is the lead contact person making the booking with Glanusk Events LLP is responsible for the orderly conduct of all guests while staying in Glanusk Caravan Park Site on the Glanusk Estate. Please ensure all guests have regard to any regulations imposed by any competent authority and that nothing will be done which will constitute a breach of the law.

10. Driving and walking around the Estate

The speed limit all over the estate is 10 miles per hour, and we would ask that you avoid driving on the verges – if you do meet someone coming the other way, please reverse to a suitable passing place. If you are walking on the Estate and happen to stray, you may be approached by one of the Glanusk staff or a tenant farmer. Please tell them where you are staying. For everyone’s sake, please keep your speed down. Pedestrians always have right of way when crossing site roads. Please take care at all times especially when near play areas and when you’re reversing.

There are private areas on the Estate which are out of bounds to the public. Access areas are marked on the maps available at Reception.

Make sure you follow any one-way systems.

When you’ve sited your caravan or motorhome, where possible park your vehicle alongside with the handbrake securely applied.

Please take care walking on site roads and tracks, as they may be uneven.

When the weather is bad, paving slabs serving as paths often become slippery and may be uneven. If you see anything that looks hazardous, please tell the Site Staff.

11. Glassware and china

Please do not take any glassware or china down off Glanusk Caravan Park Site or leave behind when you leave. If you have a breakage, please let us know and we will be happy to help clear the glass or china away. If anything is broken it can cause a hazard to animals and to humans.

12. Electrical hook ups

Please make sure your cable is placed as close to the edge of the pitch as possible.

Please put any excess cable under your outfit so that loose cable becomes less of a trip hazard.

Don’t coil your excess cable as it can overheat and catch fire.

13. LPG

We appreciate that most caravans and motorhomes have Liquid Petroleum Gas (LPG) systems fitted as standard. We strongly advise that you have your gas system checked by a “Gas Safe” registered fitter annually, before use.

Additional cylinders which are not connected to LPG systems are not to be brought onto site and no cylinders are to be left at the end of your stay

14. Health and safety

All measures have been taken so far as is reasonably practicable to ensure the Glanusk Caravan Park Site and property is safe for you to use and enjoy during your stay. Please make sure, however, that you take a little time to make yourself aware of the features of the estate, and properties where relevant, to identify any hazards which you may encounter so that you can take any necessary precautions and enjoy your stay fully. You should make yourself aware of site fire safety precautions: fire extinguisher and alarm bell.

15. Uneven surfaces

There are several paved areas with old flagstones and other uneven surfaces on the Park. Please take extra care around these areas. The Parkland is a natural environment and uneven surfaces are widespread.

16. Trees

There are many beautiful trees on The Estate including over 300 different cultivars of oak. From time to time a bough may fall from the trees, so we would advise all guests to avoid standing under, climbing, or picnicking under the trees. You will see that in some places we have roped off the areas around the trees and this is part of an on-going management programme. However, we would ask that you avoid standing under, climbing or picnicking under all the trees on The Estate whether they are roped off or not.

17. The River Usk and other areas of open water

Please do not access the river as people are fishing. We ask that do not throw stones or pooh sticks into the river even if you don’t see a fisherman or women, they may be on their way to that part of the river and we don’t wish to upset their days enjoyment by having the pool disturbed pre fishing.

Please note NO ACCESS OR SWIMMING IS ALLOWED IN THE RIVER USK AT ANY TIME.

As we have various open water courses (ponds and streams) within the Estate and Park, take extra care, especially if you have children with you.

Please warn your children of the dangers and ensure they are supervised at all times.

18. Lighting on site

Lighting is generally low-level subdued lighting and spaced to meet local authority restrictions, reduce the environmental impact comply with planning permission and reduce the effect of light pollution.

We suggest taking a torch with you if you leave your caravan or motorhome after dark.

We suggest sticking to a familiar route if you need to walk around a site after dark.

19. Animal and nature hazards

We encourage wildlife and maintain natural surroundings where possible, so take care when walking around the site. Molehills and rabbit holes, tree roots and uneven ground are likely to be present. We advise you to keep your eyes peeled for hazards and wear appropriate footwear.

We are located on and near to farms, take care if there are animals around. They can be unpredictable, so parental supervision is required. Please don’t let children get close to the animals unless given permission by the farmer.

Always wash your hands after contact with animals.

20. Hard standing

Be careful on hard standings as they are generally loose gravel and may be a trip hazard.

21. BBQs

Open camp fires are not permitted on the park under any circumstances. Free standing BBQs are permitted on the site as long as they are raised more than 8 inches from the ground. No gas BBQs are permitted.

22. Fire emergency information

Please refer to the fire emergency information located at the Amenity building and on the notice boards on site.

To make sure any fire won’t spread, keep your outfit at the required distance from others.

Carbon Monoxide kills. Keep barbecues out of caravans, motorhomes, awnings and tents. Make sure you keep barbecues away from outfits and hedges and outside of awnings and tents – please don’t leave them unattended. Let hot ashes cool down before putting them in the rubbish. Make sure exhaust from generators is properly vented away from occupied areas. Carbon Monoxide is a colourless, odourless, highly poisonous gas that can kill in minutes. Carbon Monoxide poisoning can be caused by any fuel that burns or smoulders. Barbecues can continue to give off Carbon Monoxide for 12 hours after they have been used.

You’ll find Fire Points at our Park, so when you arrive check where the nearest one is. Then you can raise the alarm if you discover a fire. Also make a note of where the assembly point is. Please read the evacuation notice, too. Fire extinguishers are provided at the fire points. Please make sure you are familiar with their use, prior to attempting to put out a fire.

If fire breaks out, follow the site staff’s instructions. Keep your children safe by making them aware of the danger of emergency services rushing to the scene.

We recommend that you have a fire extinguisher, fire blanket and smoke alarm in your outfit. They should be checked and serviced regularly so they’re always ready to use. Fire buckets are very handy, too, but must not be used on electrical fires.

23. Children

Children must be supervised on site at all times.

The parents or guardians are responsible for the safety of children in their care at all times whilst on site, particularly in preventing access to the River or any open water and on road and pathways.

Play areas are never entirely risk free, please remember you are responsible for your children on site.

Bikes, scooters and skateboards are allowed, but we ask you to keep your speed down to walking pace on the site and to be aware of uneven surfaces. Please follow the site’s one-way system.

For the safety and consideration of others, we don’t allow the use of petrol or electric scooters on site.

24. Pitch alteration

Glanusk Events LLP reserves the right to alter specific pitch requests in order to maximise pitch occupancy but will aim to advise customers of alterations wherever possible before arrival. You should notify a staff member immediately upon arrival and should not pitch until a member of staff has confirmed your pitch details. This is unlikely.

25. Extended Stays

Extensions can be arranged, subject to availability and possible relocation, although there is no guarantee that pitches can be extended beyond the date booked. If you wish to extend your stay please check with reception as soon as possible.

26. Awnings

The majority of pitches can accommodate awnings. Please note only “grass friendly” or “breathable” groundsheets or mats are permitted in awnings. During adverse weather conditions you may be requested to take your awning down.

27. Additional Tents/Gazebos

Additional tents and gazebos are allowed when they are within the allocated pitch size.

28. Groundsheets

No groundsheets separate from any awnings will be permitted.

29. Day Visitors

Day Visitors must report to the Estate Office with their car registration No. before entering the Park so that parking can be allocated on hard standing where possible.

30. Noise

Please consider your neighbours and keep noise to a minimum after 10pm and first thing in the morning. We will not tolerate unacceptable levels of noise that disturbs others. In the event of any

unacceptable behaviour we reserve the right to ask you to leave the park. No loud music is to be played at any time.

31. Flood risk information

Please refer to the flood information point located at the Amenity building.

32. Rubbish and recycling

Please note details in the Amenity building regarding recycling and rubbish collection. We would very much appreciate your help, if you are unsure about which bins to use or need any additional bags, please contact Reception.

If you have waste such as broken glass and batteries, ask site staff who will offer advice regarding disposal.

Hazardous waste cannot be discarded on site.

33. Dos and Don’ts for products and discharged liquids

Please adhere to this serious instruction, it is vital that we don’t allow any contamination to go into any natural water course and specifically the River Usk. The system is sensitive and can damage easily.

The following MUST NEVER BE DISCHARGED INTO THE DRAINS, SINK, LOOS OR WATER COURSE OF ANY TYPE:

Bleach of any type Floor cleaner or disinfectant, dishwasher or washing machine detergents Motor oil, grease, antifreeze, brake fluid etc, Bottle sterilising fluids, Cooking oil and fat Weed killer, insecticides, fungicides and other gardening chemicals Paint, thinners, white spirit, turpentine, creosote etc Medicines – take unused medicines to a pharmacist for safe disposal – the nearest one is in Crickhowell Photographic developing fluids Nappies, sanitary towels, rags, wipes of any sort Soft toys, tennis balls etc No Home beer or wine making liquid or product

34. Showers

1. To keep site standards high, the shower and toilet blocks are cleaned daily. They’ll be closed during cleaning.

2. Floors may be slippery, so please take care.

3. Take care when using showers and taps. We make sure the water is temperature controlled to avoid Legionella.

36. Fireworks and other airborne items

No Fireworks to be set off on any part of the Park.

No Chinese candle parachutes or similar devices are allowed.

37. Drone footage

No drone footage is to be taken without specific permission from the Estate by way of the Estate Office.

38. Complaints

If you are dissatisfied with any aspect of your stay at the Site you should bring the problem or issue to the attention of the owner of the Site as soon as possible so that all reasonable efforts can be made to rectify the situation. If for any reason the issue cannot be resolved to your satisfaction you should put it in writing and email it to the Estate Manager on [email protected]. Any complaints arising out of your stay at the Site that are not brought to the attention our attention during your stay are less likely to receive the same level of attention if made retrospectively.
